If you can't get an answer from Immigration and Customs Enforcement, or ICE, in a timely fashion, or if you feel you have been treated unfairly, my office may be able to help resolve a problem or get you the information you need. While I cannot guarantee you a favorable outcome, I will do my best to help you receive a fair and timely response to your problem.

Please note that if you do not live in Massachusetts 5th Congressional district, I will not be able to assist.  If you live in another district, you should contact your own Member of Congress to request assistance. Additionally, I cannot intervene in legal matters, and you should reach out to your state representative for state/local government issues.

Before I can assist, you must give written consent — the Privacy Act of 1974 (5 U.S.C. § 552a) requires that Members of Congress, or their staff, have written authorization before they can obtain information about an individual's case. Please read the following carefully before filling out the ICE Privacy Act Waiver, as ICE may reject incorrect forms.

Instructions

Step 1: Individuals may complete an ICE Privacy Act waiver in advance, which will allow the office of Congresswoman Katherine Clark to communicate with ICE on their behalf if they are detained.  The form must be completed IN FULL, including date, witness, and original (handwritten) signatures.

Step 2: It is up to the individual what information they want ICE to release to our office.  We urge individuals to check “all” in Step 2 in order for us to obtain all records.  Otherwise, ICE will restrict what information they’ll share.  If anything applies about protected records (asylum, TPS, etc.), the individual should also check those boxes in Step 2.  If any part is not complete or completed incorrectly, it may cause delays in receiving a response from ICE or it may cause our inquiry to be rejected completely.  If an individual is working with someone to translate, they should have the translator review the form carefully.

Step 3:  Any individual may be a witness; they will need to sign and print their full name in this section.

Complete: The completed form should be given to a trusted individual, such as a family member, friend, or lawyer.  The completed form may be emailed to: Katie.Worley@mail.house.gov.
